The first case to go against Ulane was Doe v. United Consumer Fin. Servs., 2001 WL 34350174, at *5 (N.D. Ohio Nov. 9, 2001) But lower court cases are not binding on later cases.. The first circuit court of appeals to go against Ulane was Smith v Cincinnati, in the Sixth circuit in 2004.
