Fair use on Castro Street Fair[edit]

Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:

1. It is a low resolution copy of a portion of the full poster.
2. It does not limit the copyright owner; either San Francisco artist Matt Hines or the Castro Street Fair organization's rights to sell the poster or derivative artwork.
3. Copies could not be used to make illegal copies of artwork on another poster.
4. The image is significant because it is the poster for a prominent public mmusic, art and LGBT event and it depicts its founder Harvey Milk.
5. This poster coincides with a month highlighting a major motion picture about the subject and is likely the reason the producers chose to feature the person; a bust of Milk was placed in city hall five months prior as well.
